Welcome to TenseQuest! These Terms of Service ("Terms") govern your use of the TenseQuest mobile application ("App", "we", "us", or "our"). By downloading, installing, or using TenseQuest, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. App Usage

TenseQuest is an educational application designed to help users learn and practice English tenses.

1. License: We grant you a limited, non-exclusive, non-transferable, revocable license to use TenseQuest for your personal, non-commercial use on devices that you own or control.
2. Age Restriction: TenseQuest is rated 4+ and is suitable for users of all ages. However, children may need parental guidance in using the App.
3. One-Time Purchase: TenseQuest is a paid application with a one-time purchase fee. After purchase, you receive full access to the App's features without additional in-app purchases.

2. Prohibited Activities

When using TenseQuest, you agree not to:

• Copy, decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App
• Remove any copyright or other proprietary notices from the App
• Transfer, sublicense, lease, lend, rent or otherwise distribute the App to any third party
• Use the App in any way that violates any applicable laws or regulations
• Exploit the App in any unauthorized way, including but not limited to, by trespass or burdening network capacity
• Use the App to harass, abuse, stalk, threaten, defame or otherwise infringe or violate the rights of any other party

3. Intellectual Property Rights

TenseQuest, including its content, features, and functionality, is owned by us and is protected by copyright, trademark, and other intellectual property laws.

The TenseQuest name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks. You may not use such marks without our prior written permission.

4. Updates and Modifications

We may occasionally release updates to TenseQuest to improve performance, enhance functionality, fix bugs, or address security issues. You agree that the App may automatically download and install updates from time to time. You can manage automatic updates through your device's settings.

We reserve the right to modify or discontinue, temporarily or permanently, the App or any service to which it connects, with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the App.

5. Disclaimer of Warranties

TenseQuest is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will function uninterrupted, secure or available at any particular time or location, or that any errors or defects will be corrected.

No advice or information, whether oral or written, obtained by you from us shall create any warranty not expressly stated in these Terms.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

1. Your use or inability to use the App
2. Any unauthorized access to or use of our servers and/or any personal information stored therein
3. Any interruption or cessation of transmission to or from the App
4. Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App

In no event shall our total liability to you for all claims exceed the amount you paid for the App.

7. Refunds

Refunds for app purchases are handled according to the refund policy of the respective app store (Apple App Store or Google Play Store) through which you purchased TenseQuest. We do not directly process refunds for app purchases.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on our website and updating the "Last Updated" date. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the App will immediately cease. If you wish to terminate your agreement with us, you may simply discontinue using the App and delete it from your devices.
